These Terms of Service (“Terms”) govern your access to and use of the PrepWise website and web application (together, the “Service”), operated by an independent individual based in Warsaw, Poland (“PrepWise”, “we”, “us” or “our”). Please read them carefully. By creating an account or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.

1. Who may use the Service

You may use the Service if you can form a binding agreement with us under the law of your country, and if you are permitted to use it under all applicable laws. If you are a minor in your jurisdiction, you may use the Service only with the involvement and consent of a parent, guardian or school. By using the Service you represent that the information you provide is accurate and that you will keep it up to date.

2. What PrepWise is

PrepWise is an independent educational study tool that provides practice questions, quizzes, case studies, mark-scheme and writing tools, flashcards, spaced-repetition study modes and related learning resources for students preparing for the International Baccalaureate (IB) Diploma. The Service is provided for personal, non-commercial, educational use.

3. Your account

To use certain features you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us promptly at hello.prepwise@gmail.com if you suspect any unauthorised use of, or access to, your account. We are not liable for any loss arising from unauthorised use of your account where you have failed to keep your credentials secure.

4. Acceptable use

You agree not to, and not to attempt to:

use the Service for any unlawful, harmful, or fraudulent purpose; disrupt, overload, or impair the Service or its infrastructure; access the Service through automated means (such as scraping, bots or crawlers) except as expressly permitted; probe, scan, or test the vulnerability of the Service or bypass its security measures; reverse engineer, decompile or attempt to extract the source code except to the extent permitted by law; copy, redistribute, resell, or commercially exploit the Service or its content; upload or transmit malicious code; impersonate any person or misrepresent your affiliation; or use the Service in any way that infringes the rights of others. We may suspend or terminate access for conduct that violates these Terms or that we reasonably believe is harmful to the Service or its users.

5. Intellectual property

The Service, including its software, design, text, graphics, question banks, study content and all related materials, is owned by PrepWise or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service and its content for your own study. This licence does not permit you to reproduce, distribute, publicly display, sell, or create derivative works from the content, except as expressly allowed by these Terms or applicable law.

Any content you create within the Service (such as your notes) remains yours. By storing it in the Service you grant us the limited permission necessary to host, store, back up and display that content to you as part of providing the Service.

6. Donations

PrepWise is free to use. If you choose to support the project, you may make a voluntary donation through our third-party platform, Ko-fi. Donations are exactly that — voluntary contributions to help cover running costs and support ongoing development. They are not a purchase, do not entitle you to any product, paid tier, feature, or service, and are, unless required by law, non-refundable. All payments are processed by Ko-fi (and its payment providers) under their own terms; we do not receive or store your payment card details.

7. Educational content and no guarantee of results

PrepWise is a study aid intended to support your preparation. While we work hard to make our content accurate and aligned with the IB syllabus, we do not warrant that it is complete, error-free, or that it reflects the most current examination requirements at all times. The Service is not a substitute for official IB materials, your school, or your teachers.

We make no promise or guarantee regarding any particular academic outcome, grade, or examination result. Your results depend on many factors outside our control. You are responsible for how you use the Service and for verifying important information against official sources.

8. No affiliation with the IB

PrepWise is an independent tool. It is not affiliated with, authorised, endorsed by, or in any way officially connected to the International Baccalaureate Organization (IBO). “International Baccalaureate”, “IB” and related marks are the property of their respective owners and are used here for descriptive, nominative purposes only.

9. Third-party services and links

The Service relies on and may link to third-party services (for example Supabase, Vercel, Google and Ko-fi). We are not responsible for the content, policies or practices of any third-party service, and your use of them is governed by their own terms and privacy policies. Your dealings with any third party are solely between you and that third party.

10. Availability and changes to the Service

We aim to keep the Service available and reliable, but we provide it on an “as available” basis. We may modify, suspend, add, or discontinue any part of the Service at any time, and we may impose limits on certain features. We are not liable to you for any modification, suspension, or discontinuation of the Service, though we will try to give reasonable notice of significant changes where practical.

11. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that any defects will be corrected. This does not affect any statutory rights you may have as a consumer that cannot be excluded under applicable law.

12. Limitation of liability

To the fullest extent permitted by law, PrepWise and any person involved in creating or operating it shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or opportunity, arising out of or relating to your use of, or inability to use, the Service. Because the Service is provided free of charge, our total aggregate liability to you for any claim relating to the Service shall not exceed the greater of the amount you have voluntarily donated to PrepWise in the twelve months before the claim, or ten euros (€10). Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

13. Indemnification

You agree to indemnify and hold harmless PrepWise from any claims, damages, losses, liabilities and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, if we are required to do so by law, or if we reasonably believe it is necessary to protect the Service or other users. Upon termination, the licence granted to you ends, but any provisions of these Terms that by their nature should survive (such as intellectual property, disclaimers, limitation of liability and governing law) will continue to apply.

15. Governing law and disputes

These Terms are governed by the laws of Poland, without regard to its conflict-of-law rules, and subject to any mandatory consumer-protection laws of your country of residence. Where permitted, any disputes shall be subject to the competent courts of Poland. If you are a consumer in the European Union, you may also have the right to use the European Commission’s online dispute resolution platform.

16. Severability and entire agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and PrepWise regarding the Service and supersede any prior agreements. Our failure to enforce any right or provision is not a waiver of that right or provision.

17. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “last updated” date above and, where appropriate, provide a more prominent notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
